BIOLOGICAL TESTAMENT IN LEGISLATION OF LTALY AND IMPROVEMENTS TO EUROPEAN HEALTH CARE ADVANCE DIRECTIVES

Abstract
The article is dedicated to the Health Care Advance Directive on the example of the Italian legislation, where the Senate passed the Biotestamento Law in 2017, which became an important stage in the development of the European Institute for the development of Health Care Advance Directives, in case the patient becomes unable make his own decisions about his health. The article gives a brief history of the establishment of the Institute of Health Care Advance Directives and examines the general and legal assumptions for the creation of this directive in the case of clinical incapacity; the law on the "Biological Testament", adopted in Italy, is consistently investigated, an analysis of its individual parts is given. Also, potential directions of legal changes necessary for the further development of the Directives for Medical Care in Europe are identified.
