PROBLEMS OF DETERMINING THE REPURCHASE PRICE AT COMPULSORY ACQUISITION OF LAND PROPERTIES FOR STATE NEEDS

Abstract

Taking into account the development of cities, which are expanding their boundaries, the necessity for execution the residential area’s general layout relating to the construction of infrastructure facilities, and the implementation of the governmental priority projects, the question of compulsory acquisition of land properties is important today. The problems of compensating exempt properties that jeopardize the civil rights and have to be settled by judicial procedure remain controversial. Numerous legal precedents indicate a lack of legislative regulation of this issue, which fact emphasizes the importance of the problem even more. The author of the article contemplates on the issues of legal regulation and implementation of norms of civil and land legislation relating to the determination of redemption price at the acquisition of land for the state needs, and points to the existing gaps in legislation.
