THE PROBLEM OF GOODS IDENTIFICATION AND RELATED RISKS IN COMMERCIAL TURNOVER OF THE EU

Abstract
The article deals with the problem concerning identification of goods and the risk, which may arise in such cases. The subject of the issue is the discrepancy between the description which is given in the document and the description which is given in some position of classificator. Such discrepancy can occur for example: 1) in the case of incomplete information about the goods; 2) in the case of absence of corresponding position in the classificator; 3) in the case of forgery of goods.This article also considers such questions as coordination of legal acts of Latvia and Europe. Taking into consideration the rules of interpretation the author concludes that the mentioned document is a more effective regulator of these specific relationships between the Private Law and Public Law and is related to commercial operations.
