Abstract

The right to protection of a suspect or of an accused of committing a criminal offense is established by the Council of Europe, the UN General Assembly and the European Court of Human Rights and is one of the basic constitutional guarantees, designed primarily to provide reliable protection of human rights in the criminal process. The article examines the influence of international law and of the decisions of the European Court of Human Rights on the Supreme Court of Finland when it considers applications for cancellation of previously adopted and already effective previous court decisions.
